Senator Jeremy Cooney of New York proposed a measure on July 20 that would expand on the state’s recreational cannabis legislation by emphasizing cultivation.
Senate Bill S7295, introduced by Cooney, would establish an adult-use provisional cultivation license, allowing growers to begin planting as soon as the state’s recreational cannabis program is implemented. In a news release, Cooney stated, “This measure allows New York cannabis growers to plant seeds in the ground so that the economic advantages of legalizing marijuana are not delayed for another growing season.”
“We approved adult-use recreational marijuana with the promise of investing in areas most hit by the failing War on Drugs,” he said. This law enables us to begin delivering on that promise by establishing a product supply chain for merchants in the new economy.”
SB-S7295 directs the state’s Office of Cannabis Management to provide a temporary license if no cultivator’s licenses have been issued before January 1, 2022. For the time being, a temporary license would provide a cultivator with the same advantages as a cultivator’s license. SB-S7295 provides the Department of Agriculture and Markets the authority to create a license until the Office of Cannabis Management can fulfill its licensing criteria, if neither a provisional license nor a cultivator’s license is available to producers by January 1, 2022.
The law supports the aim to get local growers up and running as quickly as possible so that the state can start things moving. “In the state of New York, the adult-use cannabis business is expected to be a multibillion-dollar industry. Cultivators and farmers throughout the state will need to take advanced measures to acquire and begin cultivating the required crops in order to prepare for future cannabis sales.
Seeds must be sown by June 2022, and sources of these seeds must be identified much sooner. As a result, producers may need permission before adult-use cultivator licenses may be issued,” according to the bill text.

With Governor Andrew Cuomo’s final signing on March 31, New York became the first state to legalize recreational cannabis. In a press release, Cuomo said, “This is a historic day in New York—one that righted past wrongs by ending harsh prison sentences, embraces an industry that will grow the Empire State’s economy, and prioritizes marginalized communities so those who have suffered the most will be the first to reap the benefits.”
When the bill was signed into law, it made cannabis legal for people aged 21 and above, as well as removing penalties for having less than three ounces on one’s person (and a larger amount allowed for storage at home). Residents are allowed to cultivate six plants at home and 12 per family, but only for the first six months after the law was signed (which lands in August).

According to estimates, it may be operational between 18 months and two years after Cuomo signs the law, which could imply a launch as late as March 2023.
